Terminations in a COVID-19 World

Employee terminations are never easy, but if they are done incorrectly, they can result in significant liability for the employer. The purpose of this webinar is to provide practical guidance to employers regarding the basics of employee terminations and to discuss some of the important “do’s” and “don’ts” of the termination process. Carrying out a termination in a proper, fair and professional manner may save an employer the aggravation, stress and embarrassment of having to deal with a wrongful dismissal lawsuit.

In addition to reviewing the foundations of terminations in Canada, we explore novel issues related to terminations in the midst the current COVID-19 pandemic. How will courts treat terminations and severance packages in a COVID-19 world?  Will we see the usual legal principle of reasonable notice be unaffected by the pandemic?  Or will our courts – in this unprecedented situation - accept the broad applicability of the “frustration” doctrine to excuse employers from paying in lieu of notice.
